Section 5: Aboriginal land rights and native title rights

NSW Aboriginal Land Rights Act

After the introduction of the Aboriginal Land Rights (Northern Territory) Act 1976, some states began introducing their own land rights legislation. NSW passed the Aboriginal Land Rights Act in 1983.

The NSW legislation recognises Aboriginal peoples’ traditional ownership and occupation of the land, in addition to its spiritual, social, cultural and economic importance to them. It gives Aboriginal peoples the right to claim unused Crown land to support the social and economic development of their communities.
